1. Who we are

FPLHERMES ("we", "us") operates the website at fplhermes.com and the FPLHERMES prediction tools. By creating an account, starting a trial or using any part of the service you agree to these terms. If you do not agree, do not use the service.

2. Not affiliated with the Premier League

FPLHERMES is an independent tool. We are not affiliated with, endorsed by, sponsored by or connected to the Premier League, Fantasy Premier League, any Premier League club, or any player. All club and competition names are the property of their respective owners and are used only to describe publicly available fixture and performance data.

3. The service is information, not advice

Everything FPLHERMES produces — expected points, minutes projections, captaincy shortlists, transfer plans, squad optimisations, mini-league strategy and any output of the HERMES assistant — is a statistical estimate generated by a model. It is provided for information and entertainment only.

We make no guarantee of accuracy, completeness or outcome. You are solely responsible for the decisions you make in your Fantasy Premier League team or anywhere else. FPLHERMES is not a betting, gambling or financial service and must not be used as one.

4. Accounts

You must provide accurate account information and keep your login secure. You are responsible for all activity under your account. You must be at least 16 years old, or the minimum age of digital consent in your country, whichever is higher.

We may suspend or terminate an account that breaches these terms, abuses the service, attempts to circumvent payment, or attempts to scrape, resell or redistribute our outputs.

5. Subscription, trial and billing

FPLHERMES is a recurring subscription priced at USD $5 per week, preceded by a 3-day trial. If you do not cancel before the trial ends, the subscription begins automatically and your payment method is charged weekly until you cancel.

Payments are processed by Stripe. We do not store your card details. Prices are shown before purchase and may change with notice; a price change never applies to a billing period you have already paid for.

6. Cancellation and refunds

You can cancel at any time from the billing portal in your account. Cancelling stops future charges and your access continues until the end of the period you have already paid for.

Because billing periods are weekly and short, we do not generally provide partial refunds for an unused portion of a period. If you were charged in error, charged after cancelling, or could not access the service due to a fault on our side, contact us and we will refund the affected period. Where you have a statutory right of withdrawal under your local consumer law, that right applies and overrides this paragraph.

7. Acceptable use

• —Do not scrape, bulk-download, resell, sublicense or republish FPLHERMES outputs
• —Do not share your account credentials or use one subscription across multiple people
• —Do not attempt to access data, accounts or systems you are not authorised to access
• —Do not use automated tooling to place load on the service beyond normal personal use
• —Do not use the service to build a competing prediction product

8. Intellectual property

The FPLHERMES model, code, written guides, design and brand are ours. Your subscription grants you a personal, non-exclusive, non-transferable right to use the service for your own Fantasy Premier League play. Content you enter — your squad, your league IDs, your notes — remains yours.

9. Availability

We aim to keep the service running and its data fresh, but we do not guarantee uninterrupted availability. Upstream data sources can fail, change or lag, particularly close to a deadline. Model runs may be delayed. We will not be liable for a decision you made on stale data; each page shows when its underlying model run was produced.

10. Liability

To the maximum extent permitted by law, our total liability to you for any claim arising out of the service is limited to the amount you paid us in the three months before the claim. We are not liable for indirect or consequential loss, including lost mini-league positions, prizes, wagers or expected winnings. Nothing here limits liability that cannot lawfully be limited.

11. Changes and governing law

We may update these terms; material changes will be notified in the app or by email, and continued use after the change means acceptance. These terms are governed by the laws of New South Wales, Australia, and the courts of that jurisdiction have non-exclusive jurisdiction, without removing any protection you have under the mandatory consumer law of your own country.
